Will I See Jail Time Due To Child Support

I am to appear in court on April 28th for contempt of court charges. I was behind on my support but I knew that when my taxes came back it would catch me up. A little over a month ago I received a check in the mail stating that I had over payed and that child support owed me money, so I contacted my case worker to be sure it was not a mistake. My case worker informed me that it was not a mistake but that they held more than I had owed then asked me if I had a job when I told her no she said I was to still appear in court because I do not have a job. I quit my job because my wife and I had a baby and since we have no one to watch the baby one of us have to stay home to take care of the baby. Financial it just made more sense for me to stay home to take care of our child because I made less than my wife but I send money orders in to pay my support so it is payed. Please tell me that I will not loose any time with my daughter since her and I have never been apart for more than one night and I have not been able to watch my other child grow to a beautiful young man.

Dear Curtis,

The sad part about this is that it depends on the judge you appear before. I wouldn't worry too much since you are paying. Just make sure that you explain the reasons why you are unemployed but continue to make payments. Bring in the checks that you received pertaining to your overpayment. This reflects good on your behalf. Were you given the option of obtaining a court appointed attorney for this court date?

We live in Nc, my boyfriend is $4,000 behind on his child support, he has been served and has to be in court on the 25th of this month. when the child support was set he was drawing off of nc unemployment and it was taken directly out of his check. unemployment ended,, we were able to make a couple of payments on our own after, but havent been able to in serval months,, he recently started recieving unemployment benifits out of arz, will he be going to jail because hes behind,, even if we can come up with $500.00 to give the courts
