Who Gets To Claim The Children On Income Tax

My ex-husband is going to start paying child support on our 3 children. And he said he is going to claim them on his income tax even though they do not live with him. Does he have the right to claim them if they live with me and he only has them every other weekend and a few weeks during the summer months?

Hi Sara,

Sorry for the delayed response. Who gets to claim the kids should be outlined in your divorce paper work. If not we believe that he cannot legally claim them since you are the residential parent.

Who claimed them last year?

How about if you were never married, and the child never lived with his father? Is there ANY way they can claim the child? My ex is threatening to try to claim my son this coming tax season. Can he?
