When Should I Be Paying Child Support

by Philip
(Mulberry, fl)

I have been separated for 2 years now, and i have been paying child support based on what the state of Florida says i should be paying if i were divorced from my wife. should i be paying that now or once the divorce is final?

further more, my wife keeps asking me for additional money for things (such as gas money to drop her off for visitation or for hospital bills for my daughter) does she have the right to ask for that and demand that it be added to the child support?

He Philip,

Actually you do not have to pay support until you are court ordered to do so. BUT it is good that you are paying through the system. That looks great for you to the judge and will not place you owing any back support. The extras... NO you do not have to pay at all. She can ask for them in court, BUT it does not mean a judge will grant them to her. When is your divorce final?

Thanks

i have only started the preliminary paperwork. we decided that we would each pay half of the total costs for court, i have paid my portions already, but my wife is still trying to pay her half. i am sure that is all we are waiting on before any court dates or anything like that. we are trying not to involve lawyers if possible because i know that we can't afford it. it has been 2 years since we have separated and still no court dates. i assume i have to prove to the courts that i have paid child support on my own since we have separated, should i start gathering documents now to prove that (i.e. bank statements or checks showing the amounts and the memo lines where i have written that its for child support)

i should also add, that what i am basing what i pay is the guidelines posted in the papers my (ex)wife has given me. no judge or court has ordered it
