What Is The Amount CSE Can Collect For Arrears

by Christine
(Georgia)

I live in the state of Georgia. My son turned 18. His father was ordered to pay $60 a week through a court order. A year ago the judge ordered an additional $15 per week because he owed over $14000 in back child support. Now since he is 18 the $60 a week is not collected because of his age. Instead Child support Enforcement is requiring him to pay $15 a week towards arrears of over $12000. Which means the arrears will be paid in 17.5 yrs. I don't think this amount is a fair amount that has been set by Georgia state child support. If all NCP hear about how they can get away with paying $15 a week towards arrears when the child turns 18 no one will pay ! How can I get them to increase the weekly amount?

To that comment 'get over it', maybe you should learn the child support law before you make a comment. I know for a fact that arrears are deducted from the non custodial parent's social security benefits from orders set over 25 years ago. The government doesn't consider arrears 'null and void' once the child is an adult. You can go back to court and request a modification on the arrears amount and most likely it will be granted.
