What Age By Law Can Child Decide To Go With Other Parent In Missouri

My step children do not want to have to go to their Mom's every time they are suppose to due to her lies, sometimes physical abuse, verbal abuse, and constant bad mouthing about their Father and I. Is there a law in Missouri that at some age the kids have the right to say I do not want to go and they do not have to be made to go? We thought it was 14. We thought that we had to make them go until they were 14 unless the Mom said ok and then after 14 the kids could just say no I don't want to go and they didn't have to. We want to help the kids and not have to put them in the situations their Mom does, but we also do not want the cops at the door causing the kids more stress and making them go with their Mom after she is mad they don't want to go. Please tell me what we can do to help them and if there is a law that protects their rights.

Thanks for your post and we understand your concern. At this point it looks like your situation is a matter of custody. If there is emotionial and physyical abuse of a child taking place, a child should be removed from a home.

If the above is true you and your husband should seriously consider filing a motion with the courts for residential custody. How old is the child and how long have you guys been actively in the child's life? You can respond via this post.

The Child is 14 and the Father has been in the childs' life it's whole life and has had joint custody with the child living with him for the last 2 yrs. The child just does not want to go see its Mother as she does nothing but talk bad about the Dad and Step Mom the whole time and the Mother says things like go tell your BFF (best friend forever) step Mom how bad your weekend here was. Also the Mother is no stop lying about everything and the child is tired of all the lies. The Mother tells the children she could have the Father and step Mother arrested for multiple things that are not true, tells the children that the Father and Step Mother have brain washed them into not liking their Mother, then when the Mother becomes upset she starts pushing the children around and calling them names.

Well it sounds like you and your husband should file for residential custody. It appears that the kids would be better off in your care.

Step Mom needs HELP

I need help! I am a step mom of 3 boys ages 13, 14, and 16. Mom left and Dad has had FULL legal and physical custoday since 2001. Now she is taking us to court for 50% custody of 13 year old and 16 year old. Neither of these boys have a relationship with her. Our 14 year old is in her mothers home because her sexually molested our 7 year old daughter that is biologically ours together.

What rights do I have? Will a judge even consider this being that the 14 year old is going through the jouvinial court system.

Seems very unfair and we feel she is doing this just to upset us and make us suffer more than we alreay are and are still knee deep in treatment.
