Visitation When Non Custodial Parent Lives Out Of State

I reside in NJ and my baby is only 3 months old. The father (non custodial parent) wants to keep him out of state, New York, overnights. I don't agree to this. Will the courts rule in my favor? Can I ask for a fixed visitation of day visits or visits at my residence since the father lives out of state and the baby is still quite young?

Thank you for your question. Unfortunately when you are dealing with the court system you cannot say how a judge may rule. They may rule in the favor of the father and give him standard visitation. You can however express to the courts about your concerns with your child being so young and overnight visits out of state.

Have you considered speaking to your child's father and work out a resolution that you both can live with?
