Visitation times for 6 month old baby

My son is 6 months old and his father and I were never married, however were living together. We just had to move out and the police were called so my son and I could leave safely because he didn't want to let me leave with him. He lost his license due to a DWI and I am scared to leave him overnight on a visitation. What are my options? I need to know asap as Saturday is when he will be seeing him.

If your ex does not have court ordered visitation then he has NO rights. We are not telling you to keep your child away from him, BUT if you feel uncomfortable leaving the child with him then you don't have to at this point.

Now, having said that, we must inform you that if your ex ever goes to court to get a court ordered schedule, YOU must then abide by that schedule. We recommend you encourage him to do this, so that things run smoothly in the future.

The courts would prefer that parents work things out themselves BUT, if the police is being called it appears that a set order would be best in your case.

Is this something your ex is willing to do?

Thank you for the advice. I am leaving in a little bit to go to the family courthouse. He said yesterday he is filing for joint custody. I don't know if I mentioned before but he has NO license due to a DWI. What if there is an emergency with my son and he can't take him? The courts really wouldn't issue joint custody because of this right? I told him I have no problem with him spending the day with our son. He wants him friday night, sat, and sunday. I love how he is making up his own visitation and said that is what the court would order anyway.

We don't think he can get joint custody if you guys were never married. It's good if you can work out the schedule on your own but if there is a history of problems like you mentioned a standard court order is better.

Without a standard order either parent can play games when mad or upset and use the child as bait. See it it works, but the minute there is consistent problems, a standard order should be pursued.

I agree that there should be a visitation order placed as he will not work with me at all on this. My concern will and always will be my sons safety and happiness. Thank you so much for all your help.
