Unable To Modify Child Support Case And Get Into Court

I have been trying and trying for over a year now to get my case into court for a judge to decide the punishment for the ncp or non-custodial parent. I also have requested for a modification for the medical part. My son is no longer on Medicaid and is now on private insurance. The people in San Antonio Child support Division keep telling me that it will not go to court until they can verify a residence and or employment for the ncp. I do not understand how they cannot locate him if they have his DL # and his SS# and his License plate number. I have provided a lot of information regarding the location of the other parent, and they keep telling me it’s not good enough. Also, is he going to keep getting away with not paying if he does not answer the phone or list a permanent address or a regular employer that takes taxes out? He is getting paid cash right now and I do not know what to do anymore.

PLEASE HELP!!!

Hello Sandra,

We need to know what method you are using when trying to get your case into court. Are you going through child support, or did you file your own motion directly with the courts. Also we need to know if the NCP lives in your state.

Unfortunately, it can be a cat and mouse game trying to locate the NCP. The first thing you to do, is get this matter in front of a Judge. When you do go to court, you need to provide the courts with the last known address of the NCP. You may have to press the issue for awhile, but eventually he should be held in contempt of non-payment of child support. After awhile a warrant may then be issued.

Also it’s not just a matter of the agency not being able to find him. Most child support departments have a very large case load, and it’s a matter of priority. It’s a shame because so many people need child support, but it’s just how it is.
