Stop Child Support Arrears Payments Florida

My oldest daughter took custody of her younger sister at both her father and my consent several years back. The reason was the younger sister (15 years old) was going to spend a year or more in a Juvenile Facility for one of many criminal and drug related charges and sister lived close so she could sign papers etc.

Father was on his way to prison(nice i know) and I lived 500 miles away. When younger sister got out (she was 17) she lived with her sister for a few weeks until she went back to jail.While she was out older sister needed food stamps and in order to get them she had no choice but to open a child support case.

The support case came up on the younger child's 18 birthday so an arrears amount was ordered.Older child never did get the food stamps for her sister one reason being that little sis was only home from jail about 3 weeks total between the ages of 15 and 18 and as a matter of fact is in jail now. Older sister wants the support to stop. She did not want it in the first place but was forced to apply for it to get the food stamps she never even got.I am mom and this is hurting me as I can not pay it.

I am sole support of young children and am on public assistance now. My older daughter has said more then once she does not want this and will do whatever it takes to stop it but does not know how. Child support worker said all she had to do was request the case be closed. The support is arrears every penny of it and she does not want or need it. How does she stop it? Can she stop it?

Please help I am looking at jail time for non payment and the fact is if I pay it I can not pay rent for my 2 young children.

Dear Nichole,

Your daughter can attempt to close the case. It must be filed through the courts and ordered by a judge. BUT, anytime welfare is involved it is very difficult to close a case or waive any arrears. If she received any assistance at all, or if she is currently on the system, the case cannot be closed. Has she filed out the proper paperwork?

she did not get any benefits and has not done paper work to close case yet due to not having a vehicle to get around. We were told by a child support case worker that se just needs to sign a paper and it will be closed immediately but take 30 days too get out of the system.
