I live in GA and back in 2004 my ex-wife and I agreed on an amount of around $500 a month in child support for 3 children because she made as much or more money as I did. I was writing and giving her checks in her hands every month. She got mad because I wasn't giving her the money in one lump sum, so she lied to the Child Support Enforcement Agency and told them that I wasn't giving her the payments as ordered. I went to the agency and proved to them that I had paid her and I was informed that she signed an affidavit saying that she was not to accept any more checks from me and that she was to inform me of this. The agency would not give me a copy of this document. In any case she didn't say anything.


Although I proved that she lied to them, they did not drop her case but continued to proceed with deducting the money from my check. Now it's review time and the state of GA. DHR is recommending that I pay $937.00 a month.

Although I didn't lose my job I have more expenses than I had with the first order which may cause me to foreclose on my home. My question is if we are actually concerned about the welfare of the children and time spent with parents, can the child support order be reduced or wiped out if I kept the children 1/2 the week and alternating weekends?

Yes your child support order can possibly be wiped out or reduced. Keep in mind that this may or may not happen. First you will need to file a motion with courts to modify your visitation schedule. You will need to specifically be granted a shared parenting order.

Presently I have a child support hearing Feb 17, 2010.
I have visitation with my kids now every other weekend, weeks during Christmas Holidays and other holidays that fall on my weekend.

Thank you for this Article. Fathers? right to be a meaningful part of their childrens? lives, have been eroded to the point of non-existence. My research suggests that this is a phenomenon consistent throughout the industrialized nations. Children who are alienated from their fathers are more likely later in life to have emotional/behavioral problems, suffer from depression, drop out of school, fail in their jobs, and suffer from other social problems.

Since writing on this page about getting my Child Support reduced I found out through DNA Test this weekend that my oldest child is not mine biologically. Will this reduce my support since this is brand new information?

Your child support won't be lowered on the count of this, but it can potentially be wiped out since the child is not yours biologically. Does the mother have any idea who the biological father is?

I'm sure she knows who the father is or could be but I have no knowledge of who could have fathered my daughter. I have a set of twins with her also that are in fact mine.
I don't beleive that I should be financially responsible for the older child but I am willing to keep my relationship with her.
I wonder if in GA. that there is a provision that will stop the Child Support for the older child and I continue to be a father in her life.

If your court date is tomorrow, you should take that paperwork with you into the hearing. It seems like that's all the proof that you will need to get the current order potentially wiped out. Let us know how we can be of further assistance.
