Paying Child Support With No Order

Hello my name is Kenneth. I currently work in the state of Indiana. My ex girlfriend and I move to Indiana about three in a half years ago. After we were here about a year and a half she decided to move back to Tennessee with her parents... She took our then 7 month old home with her. I went on the Indiana child support calculator. There I found how much I was suppose to pay weekly ($112.00). I have never missed a payment. I also pay 60 a month on top for daycare for my son.

When she first left with him I tried to put myself up legally for child support but the family court of Indiana said no. They explained to me that I had already signed the birth certificate as his father so I could not petition the court to pay child support. This didn't at the time nor does it now make Any sense. I never disputed the paternity of my son. I just wanted a record to show that I was paying.

I did not pursue a custody battle at the time because the same court informed me that my ex would be forced to remain in Indiana or leave our son here until custody was established since this was his birth place. I could not bring myself to put my son thru that. In addition she promised to let me see my son pretty frequently.

This brings me to my present situation. I don't get to see him. I travel to Tennessee every other month to see my son and she refuses any over night visits unless I stay at her moms house with her. I am in relationship now so you could see where that can be a problem. I feel like my hands are tied.

I am a convicted felon but have turn my life around drastically in the last three years. I'm on probation and have been a model probate for the last three years.. I don't know where to turn can some one help please?

Dear Kenneth,

Thanks for sharing your situation. You should consider going to court and filing for court ordered visitation. They will consider the fact that you each live in different states. Also, did you call your county child support office and try to open a child support case?

You really need records of your payments through the system. You also need to see your son. With a court order she has to comply. Otherwise she may be in contempt.
