paying child support when I have my son full time

In February of 2010 i was served with papers stating i needed to pay child support for my 3 year old son when(at the time) me and his father were sharing custody (mutual agreement, not court ordered) right after i was served papers his father got arrested for drugs and was in jail for a couple days, he was then released and went MIA. During that time i was trying to figure out what i needed to do to stop the payments ( since i then had my son full time) i called the child support office about a dozen times when finally a lady told me to file for food stamps so i had proof i had my son. i then went down to file for food stamps and his father was claiming our son wiith food stamps also!

i then went to talk with a child support worker in person and they told me my case was dropped, but about a month later(may) i was served with more papers stating since i didnt try to fight the first papers i was served i had to pay child support to his father in the amount of 147 a month.

i then had to fight with child support again to see what the problem was and after days of calling and speaking to a supervisor she stated the only way to stop it, even though i was trying before the court order and i had my son full time, was to file through the courts or his father could call the child support office and stop it.

I was in the process of finding out what papers i needed to file when in june his father called to say he had clothes for our son i then told him he needed to call child support to stop payments, he said he would but instead called to persue the child support! The child support office didnt even question him about it even though i had been calling for months about his fraud! I now am getting my checks gransihed and only getting about 180 dollars every two weeks, we cant pay bills and buy winter clothes or food on that amount and the court wont file my motion to stop it untill i find his father and serve him papers (since i cant afford a lawyer i am doing it on my own) but his father is no were to be found. im looking for answers on how the state of idaho can make me pay child support without looking into who our son is with? it doesnt make sense and needs to be changed!
