Passport Suspension Due To Back Child Support

I reside in the state of Oregon and my ex-husband owes me $185,000+ in back child support and spousal support. I read online that it is a federal law that if there is more than $2500 owed in back child support that his passport is denied. He already has a passport. I'm concerned because his wife's family lives in Australia and he has plans to go there in September.

Can I require that my case worker suspend my ex-husband's passport? Is this really a federal law that my case worker is required to enforce? They are not easy to work with.

I have put an alert on my older son's (16) passport application so he can't be issued a passport to travel with my ex-husband, his wife and their two boys. I'm afraid my ex-husband will stay in Australia and not return to the US if he is able to travel there or anywhere out of the US.

Hi Linda,

Yes you can request to your caseworker that his passport be suspended. Especially express your concerns about his in laws living in another country. It is a government law. I am surprised that when he renewed it did not get denied. Do you get his taxes offset to you?

Thank you for your comments. I spoke to my caseworker and she told me my ex-husband's passport has been suspended. However she also alluded to the fact that Australia is a reciprocity state of the US and his wages there could also be garnished. Currently he is unemployed.

No, but I am looking into the tax suggestion.

Make your own living for yourself. Your ex-husband's familys needs comes first before yours. I'm sure he wants to go to Australia to have a better living and employment. Why do you care where he goes. It doesnt change the fact that he still owes you money.

You woman are selfish beings. You want everything about a man life suspended or taken for a couple hundred dollars a month in child support. How pathetic are you that you cannot live without that??

If he doesn't want to be a part of that child's life then its YOUR responsibility to take care of the child or you should have had an abortion if you could not afford to take care of the child and have them suffer because you're not stable enough to do it.

I'm sure you don't even want to let him see the child but you want money from him.You don't even get all the money when he does pay child support. Bet you didn't know that. The agency takes administrative fees out which is why they are will to track him and destroy his life but you think that's ok.

Yes there are deadbeat dads out there but not all deserve the punishment that comes along with child support. GET A DARN JOB!!!
