Over Payment Of Child Support

Child services after reviewing my case found out that I overpaid for them 4000 and they gave it to my X-wife who was the residential custodian but the child services also says they can not take that out of the spousal support payment.

I never was told that I was overpaying them for child support and they were taking both payments from my paycheck directly as one payment weekly.Some how all of sudden after I got a court order to stop payment, they restarted taking more money as spousal support again,now they are telling me they figure out that I overpaid the child support but they can not use that toward the spousal support even thought that they paid it to her directly.

Also the court had ordered for me to get cash during the period that I had the kids living with (my x abandoned the kids and left them with me in January and finally I filed with the court in April and they ordered to hold the payment till court date in July and in July the court order to pay me 2800 dollars but child services sent the money by mistake to my x, I never was able to recover it.

Then in September the court ordered child services to pay me up to 7500 of the money that still being collected from through the whole process.

Child services were able to pay only 7060. They finally stopped taking spousal and child support in September and my x was suppose to take 2 more months(2000) since I was suppose to pay till November but because she already got the 2800 I was told no need for that.


Then I was surprised in January CHILD SERVICES SENT ME A NOTE THAT I STILL OWE 6000 of child and spousal support and started taking the money automatic again,and when I filed for my taxes the held my 6000 of tax refund while still taking money from my paycheck up to now another 2000 dollars. after taking with child services they told me to take them to court.

I am so frustrated. Not only I paid my for 4 months while the kids were living me because she left them,I paid another 6500 dollars of legal fees just to get the kids legal residential custody and to keep them in state after she willingly left the kids and moved out of state saying she will be back in 10 weeks but sent me an email that she was not coming back after only 4 weeks after she left.

The child services visited me after I told them that I have the children in January but still did not stop the payment even though the law says the residential custodian suppose to tell the child services about changing the children address 2 weeks before the move. still they did not stop payments till I filed through the court in April.I need your help please. Sorry my thoughts are very scattered but I hope you can understand the main situation.
