Not Paying Child Support Yet


(New Orleans, La)

A woman and I had an affair about 8 1/2 years ago. She and I were both married to someone else. She got pregnant and says it's mine. The little boy is 8 years old now and has her husband's name. Her husband knew it wasn't his and I'm not positive he's mine either since I wasn't the only one sleeping with her other than her husband. I have never denied the possibility and when I offered to help they both said leave their family alone.

We, my wife and I, even met at an appointment with her case worker to get things started for a paternity test; but she didn't show up. I believe she has made this public not to get things in order but to be a nuisance to me since she knows her husband isn't leaving her. What I want to know is what can she really do to me after 8+ years and does it matter whether her husband signed the birth certificate or not? This is really hard on my family and every so many months years they come around talking about money. Is there anything she can do to me in court?

Legally yes a judge can hold you financially responsible for the child. BUT, it doesn't look good that she is "missing" appointments to have paternity test. No the birth certificate does not matter. Signed by him or not it is the blood DNA test that matters.

The man who signed the bc is legally that childs father period..and in some states even if you have a dna test to prove that he is not he will still be held responsible..not the biological father...the husband is automatically named as the father its the law even if at the time of birth they both stated he was not the father he would still have to sign the bc..
