Non Custodial Parent Has No Emplyment

I have a child with someone whom is very childish and manipulative. We live in the State of Michigan. He was just arrested last week for 3 outstanding child support warrants for his other 3 kids. As of two years ago he was 48,000 behind.

Since then we have had a child together but split up before our son was born and now he has custody of one of the children he owed support for and had a new baby #5 two weeks ago.He got out of jail already and I'm not even sure how.

We went last week to establish paternity on our son since we did not do that at birth 15 months ago. I was also told by the prosecuting attorney that I am not eligible for back support because support was not established.

He is claiming to tell me that his support order for the one whom he has custody for has been froze and once motion for support goes thru on her that the mother will be the one to owe him money and they will take it off his arrears and that the support order for the other two cases are held up ad under review because he has no employment.

I was always under the assumption that even though you do not have a job you still have to pay support, and they do not forgive arrears for any circumstance whatsoever. I have heard of them forgiving interest but not the actual arrears themselves.

He also stated to me that they are supposedly giving him his drivers license back. He said the judges said they would remove the hold from his license and since all 3 are in different counties they all have different policies but assured him he is getting it back from all 3.It sounds to me like he is feeding me a bunch of crap.

Some answers would be greatly appreciated!!! I guess my other question is will an order for my bet made even though he has no employment at the moment??? Also he has seen my son 5 times since birth the last time being when he was 6 months old.

He has no relationship developed with my child. Should I let him visit my son without an order in place or should i wait for the order to go through so I don't end up screwing anything up for me and my son???

Hi, I live in Florida and like you have child support issues. It really depends on your states laws on child support. In Florida it doesn't matter if you work, they will asses you at minimum wage, if you the petitioner can't prove he's ever made more within the past 2 years.

If he has made more in the past, they will asses child support payments from his past earning potential. He would be required to bring his last 2 years of tax returns with him at the hearing, along with all other documentation of his income.

If he brings nothing and pretends he doesn't work,and the judge catches him in his lie, which happened in my case, the judge will asses the child support to what the judge believes he is making, again in my case that was $10 an hour instead of minimum wage.

Unfortunately in your case he has several children, so the judge will take into account the expense of children that live with him and deduct any other child support he is ordered to pay before you see anything, which sounds like you will be lucky to get $50 a month, if the judge asses' him at minimum wage. The judge will ask why can't you work sir?

Do have a disability which he actually can document, not just says he has, if not then the judge should put him at minimum wage.Also some states can only go back so far on child support, In Florida it's only 2 years, the judge was going to give me 4, but unfortunately the law was 2.
