New Custody Situation Summit County Ohio

My ex wife has has full custody of my daughter. Recently I obtained emergency custody and I care for her now and it probably will be awhile that I will have her. I pay almost $400 a month child support for my daughter, so how can I get that stopped since she is in my custody now. Her mother is being charged with domestic violence and child endangerment towards my daughter. And how do I go about getting support from her now?

Full custody, I doubt but joint custody is being pursued.

File A Motion With Courts

Hello Kalven,

CSE or the courts won't make her pay you child support based on the fact that you have temporary custody. Your only chance at getting the order stopped is filing a motion with the courts for joint custody.

Even if you get joint custody, it's still not guaranteed that your order will be stopped. We recommend that you obtain a good attorney to argue your case as to why you feel child support should be ceased due to joint custody.

So basically your saying she has the right to still receive the support payments even though she don't have he in her care and I'm the one responsible for feeding her etc..?

She still has the right to receive child support because she still has full custody and you have emergency temporary custody. Again, things could change when you are granted shared parenting.

Same boat

I'm in the same boat. My boyfriend's children's mother has an addiction to prescription medication. He recently got partial custody, but we've since taken the kids into our home because they're afraid to be alone with her. How does he go about getting emergency custody?

You need to contact your Child Support Enforcement case worker and let them know what is happening. They will review your claim and may suspend payment. Child support may still have to be paid, but it will be held until the matter is settled and either returned to you or paid to her depending on the outcome of the case. You will need to provide proof of when your child moved into your home and why.
