Moving Out Of State

I have a 5 year old daughter that I have raised without her father in her life for about 4 yrs with my parents. We have not been together in 4 ½ yrs. I want to move to Texas for a better life for me and my daughter. I am currently not working right now and as far as I know he works under the table with his dad doing construction. She has her own room at the house where I live and if she where to live with her father that would not be possible.

She would live in a home that houses 3 kids, 6 adults, and numerous pets all in 3 bedroom house with only one bathroom. The house is approximately 1000 sq ft. He has not paid child support up until the past five months. The checks are less than 100 dollars and are not consistent. Am I legally allow to leave the state with my child without any consent from the father, and if not what must be done for me to leave the state legally and start a better life for me and my daughter.
