Limitations on withholding arrearrages

by Ed Meyer
(Belton Missouri)

I owe (not in dispute) back child support with no current support(State of Michigan), 2 years ago I lost my job in Florida, and ended up moving to Missouri and eventually found a minimum wage job where I average between 20 and 30 hours a week.

While working in Florida arrears were being taken from my pay, and I had no complaints, I in fact do owe the money, and am perfectly willing to pay it.

Unfortunately they are now withholding 50% of my minimum wage paycheck, leaving me between $27 and $98 dollars a week to "live" on.

I have made numerous attempts to contact the child support worker (Genessee County Michigan), without receiving any replies.

DOes the 30 hours a week withholding exemption stated in the CCPA, apply to my case?

I have made an offer to pay at least $25 a week until either I find a better job, or my hours are increased.

No human being can be expected to survive on the amount that I am allowed to take home, were it not for my brother giving me a place to stay, I would be totally homeless, and working in a restaurant now at least I can eat occasionally.

Any help would be greatly appreciated.
Thanks
Ed Meyer

Just an aside.

The CCPA was I believe written intentionally to be vague. There is a lot of help available out there for those trying to collect child support, but no avenues open to anyone who has the need to challenge it.

People in my position (along with many others),are held completely at the mercy of a broken and legally biased system, and it appears that theres no relief in sight.....Our best bet is to quit our jobs and illegally earn money "under the table"....or maybe were just not worthy of survival in the eyes of the "system"

How dare you suggest that anyone can support a kid on $25. Get a second or third job, loser.

As to the "Anonymous" comment, You need to get a grasp on reality, maybe you should learn a bit about "facts" before you open your smelly mouth and spew forth feces... Laws, whether you personally like them or not, are put into place and are legally required to be upheld in defense of EITHER PARTY..not just the party of your choice. The child in question just happens to be 30 years old, and is not receiving a penny of the support being withheld, the money is instead being "paid back" to the state of Michigan for welfare that the mother recieved.
I suggest that you strongly consider thinking before you talk your fecal matter.
