Is Child Support Intended To Be Used For Food Clothing And Shelter?

I have two kids and I have been paying child support. We are joint custody but she has residential custody. She receives about $600 a month between the two of them for child support. I asked her for a few warmer clothes to have on hand and she said she is low on winter clothes for them. I asked her to use some of the support she gets from me to buy them some clothes. She makes the assertion that I am wrong and that the money she gets from me doesn't necessarily have to buy them clothes etc. On top of that I also cover their medical insurance and half of the day care. All in all, I pay over $1100 a month and take home about $800. It’s barely enough to live on. What should the payee of child support be required to guarantee the kids in this situation from the money sent?

Hello Ty,

We appreciate your post and understand your concern. Child support is intended to assist in taking care of all household expenses for the child. This also covers any other necessities such as clothing.

Unfortunately there is no law set forth to govern how the money is spent. Unless you can prove that the money is being used illegally or to harm the child, she can freely use the money how she chooses.

It's a sticky situation because non-custodial parents pay child support but still are required take care of the child when the kids are in their care.

If you feel this is unfair and you are paying too much, you could always request a child support modification. If your child support gets lowered you could use the extra money to buy the things the mother won't purchase.
