Ex Will Drop Child Support Arrears

We live in Georgia and back in 2007 my husband went to court for back child support and was ordered to pay $115.00/wk plus $200/wk towards arrears. He couldn't meet those terms and so he had a bench warrant for failure to appear/ contempt because he didn't go to court. We now are on good terms with the ex and she set it at $75/wk and we have been paying every week for a while.

He just got arrested for the warrant. She has agreed to give forgiveness because we have been keeping current. The case also has been a civil case and is not tied up in child support recovery. What should be done to take care of the arrears? I know he will have to appear in court for the bench warrant but what does the ex need to do to five forgiveness for the arrears?

Hi! I am giving an update on my question. I actually typed the papers up myself with all the legal terminology. She did however change her mind on FORGIVENESS but instead she agreed to half the arrears if we agreed to pay $100/wk. $50 of that would go to arrears and we will have the arrears paid in 6 yrs.

If we didn't agree to that she would keep the arrears at 30,000 and it would take 23 years. NOTE: Girls if you ever get with a guy who is paying child support and your not getting receipts and he says, Oh she won't do anything spiteful, we don't have to get receipts. You take control of the situation and do like I did, Get a MONEY ORDER.

It's proof of receipt and you don't have to deal with the pain in neck ex. If you don't you will be like we were with a woman in court with a kick butt lawyer saying you never paid child support and you have no grounds to stand on to say otherwise and they will put your husband/boyfriend in jail.

After she found out we were having our 2nd child she got mad and filed arrears all the way back to the Friday after the Wednesday their divorce was final. And held out on letting us know she had filed the papers back in August and had them served on February 14th (my birthday/Valentine's day) that we needed $5000 to keep him out of jail.

Anyways, on a final note I drew up the papers, had the ex sign in front of a notary and had my husband sign in front of a notary. Took the papers to the Superior Court of the County and filed the papers, took those filed papers to the county jail and they faxed the papers over to the judge that signed the bench warrant and he signed off on the hold for contempt. Good ending to a child support horror story. Good luck to all of you reading this.

RECEPTS WITH ARREARAGES OWED ON THEM

I CAN'T STRESS ENOUGH NEVER EVER PAY CHILD SUPPORT BY CASH GO THRU SDU OR THE CHILD ENFORCEMENT PAYMENT CENTER IN YOUR COUNTY. MY HUSBAND BACK IN 2001 ORDERED TO PAY CHILD SUPPORT. IN 2006 HIS EXWIFE TOOK HIM BACK TO COURT .WE HIRED AN ATTORNEY WHO DIDNT KNOW FAMILY LAW WE LOST OUR A--.WE GOT A NEW FAMILY LAW ATTORNEY WHO IS A BULL DOG TO APPEAL THE JUDMENT OF 12,000.00.WE HAD WITH HIS XWIFE SIGNATURE ON THEM RECIPTS ALSO MY HUSBAND PUT THE ARREARAGES ON THEM AND THE AMOUNT HE PAID SHE SIGNED THEM AND SHE WAS TRYING TO GET HIM FOR 56,000.00 DOLLARS. ON THE STAND SHE ADMITTED SOME ARE OF HER SIGNATURES THE ONES SHE ADMITTED TO HAS THE ARREARAGES ON THEM.THE ATTORNEY WE DID HAVE FAILED SO MY HUSBAND GOT A JUDGEMENT OF 20,0000. OUR NEW FAMILY LAW ATTORNEY BROUGHT IT ALL TO LIGHT. IF THINGS GO RIGHT HIS X WILL OWE HIM.
