Can I Still Get Back Child Support Arrears

When my son was born his dad was getting ready for deployment to Iraq. His dad has never really had anything to do with me and my son. When my son was about three months he then deployed my son has never met him but he only seen him when he was 8 days old.


When he got back from deployment i filed for child support to get the DNA test. I work for the National Guard full time. While he was deployed i got married to a wonderful man who accepted my son i then asked my sons biological father if my husband could adopt my son.

My sons biological father and i have always got along and he agreed to the adoption. When he got back we got a DNA test and they established child support for a years back pay and on-going child support.

I told them that i didn't want anything i signed papers. I only receive about $400 from him during the time of his deployment until the adoption was complete. My son was two years old at the time when the adoption was complete. He is now 3 years old.

My question is even thought i signed papers saying that i didn't want anything can i go back for the back pay for the two years until the adoption was complete. Thank you any information is greatly appreciated.

We have a couple of questions regarding your post. Did you close the child support case once you signed the papers, and was the papers signed in court or through a child support agency?

They said by signing those papers i would close my case it was through the child support office not the courts. Also when i log into the child support office website to see what last actions were takin it does not show that my case was closed.

When i signed the paper work it was at the child support office it was never done through the nm district courts. They didnt tell me the case would be closed. I have logged into the NM child support website to see what last actions were taken on my case and it doesn't say the case was close. It just says that paternity and child support was determined.

Back Arrears

If your case is still open you should be able to speak with a case worker. It also appears that if you signed paperwork stating that you waived the arrears, then you may have to live with that decision.

However, you may need to seek legal counsel to have them take a look at the paperwork to review what was stated in the agreement. We can't give you a solid answer, as we don't know all the details inclosed in the paperwork that was signed.
