Can He Take My Son Away From Me

The father of my child has never been there for me or my son other than at the hospital when my son was born. He does not help with diapers, formula, clothing or anything. He hardly ever comes around and the girl he is currently with is always trying to start problems with me. I've tried to avoid the whole situation by avoiding him. He has tried to get a hold of me to see my son maybe 4 times since my son has been born. My son is now 4 months old. I have never denied him the right to see his son but things are starting to get worse.

When I ask him for help financially he makes a big deal about how I should have thought of that before I had the baby and so I don't even bother with asking any more. A couple of weeks ago he asked if I would let him take my son to a birthday party of one of his girlfriend's family members. I don't feel comfortable with letting my son go with his father if he is going to be around the girlfriend because she has threatened me and has threatened to do things to my car. I told him no and he got really mad. He said that he was going to take me to court and take my son away. He said he would definitely get custody of him because he didn't live with his parents(like I do) and he makes more money than I do. Can he do this? I am so scared because my son is my everything!

Dear Stacy,

It all is based on what the judge decides. It is going to be very costly for your ex to take you to court for custody. Also he will have to prove that you are an unfit mother. That can be very difficult to do on his end. Do you have a child support order in place?
